F.A.Q.
Why do I need to register my Trade Mark?
The registration of your trademark will provide you with an exclusive right to use of the trademark in the course of your business and a unique identification for your product.
OR YOU MAY CHOOSE THIS WAY AS BELOW:
You do not need to register your trademark, if you have thousands of pounds at a later stage when someone threatens to bring proceedings against you for using their registered trademark.
As an example: you have a successful restaurant called the Knight of The Sea on the high street of King’s Lynn in East Anglia and operating for almost 20 years, but you did not register the name of your restaurant as a trademark.
One day you receive a letter from a solicitor demanding that you must change the name of your restaurant and pay damages to their client, a pub chain operator with several pubs all over the country, for unlawfully using their client’s registered trademark the Knight of The Sea. They registered the trademark just eight years ago, if you were registering the trademark when you started trading then you will not have this problem.
What do you do? - You need to obtain legal advice.
Where do you go? - You have no idea as this area of the law is not wildly practiced by high street lawyers. You will need to go to a specialist firm with trademark knowledge to obtain legal advice.
How much will that cost? - That might cost you several hundreds of pounds and you still not solved the problem as may go to litigation.
We had a client a couple of years ago who previously paid £3000 in legal fees and spent many sleepless nights to solve this type of problem, but had to cease trading in that name and had to choose a new name. Finally, we registered that new name as a trademark for him.
However, with less than £500 pounds to register your trademark you would avoid the unnecessary hassle of litigation and you can be sure no one can take your brand name.
